The Parliament of Montenegro has adopted the Law on Amendments and Supplements to the Labor Law.

This law introduces changes and supplements to the Labor Law (“Official Gazette of Montenegro,” Nos. 74/19, 8/21, 59/21, 68/21, and 145/21) regarding the duration of fixed-term employment contracts. Under the amendments, an employer cannot conclude one or more fixed-term employment contracts with the same employee if their combined duration, whether continuous or with interruptions, exceeds 24 months.

Additionally, a new article addresses the regulation of employment relationships established before the enactment of these amendments:

“To regulate employment relationships between the employer and the employee governed by a fixed-term employment contract concluded before the enactment of this law, where the duration exceeds 12 months, the provisions of the law in force at the time of concluding that fixed-term employment contract shall apply. For employment relationships governed by multiple fixed-term contracts concluded before the enactment of this law, where their combined duration exceeds 12 months, the provisions of the law in force at the time of concluding the first fixed-term contract between that employer and that employee shall apply.”

This Law on Amendments and Supplements was published in the “Official Gazette of Montenegro” No. 77/2024 on August 5, 2024, and enters into force on the eighth day following its publication in the “Official Gazette of Montenegro.”
