The Parliament of Montenegro has adopted the Law on Amendments and Supplements to the Labor Law (“Official Gazette of Montenegro”, no. 086/24 of 10.09.2024). This law introduces amendments and supplements to the Labor Law (“Official Gazette of Montenegro”, no. 74/19, 8/21, 59/21, 68/21, 145/21, and 77/24), specifically concerning the provisions related to the minimum wage.

In Article 101, paragraphs 2 and 3 are amended and now read:

Minimum Wage Article 101

  1. An employee is entitled to a minimum wage for standard work performance and full working hours, or working hours equivalent to full-time work in accordance with this law, the collective agreement, and the employment contract.
  2. The minimum wage from paragraph 1 of this article, in net terms, cannot be lower than 600.00 euros for employees in positions up to the V level of education qualifications, or 800.00 euros for employees in positions with VI and higher levels of education qualifications.
  3. The amount of the minimum wage from paragraph 2 of this article is determined by the Government of Montenegro (hereinafter: the Government) on the proposal of the Social Council of Montenegro, based on criteria for determining the level of minimum wages, including:
    • General wage levels in the country;
    • Living costs and changes in them;
    • Economic factors, including the requirements of economic development, productivity levels, and the need to achieve and maintain a high level of employment.

The provision of Article 1 of the law stipulates the amendment of Article 101, paragraphs 2 and 3, so that the minimum wage cannot be lower than 600.00 euros for employees in positions up to the V level of education qualifications, or 800.00 euros for employees in positions with VI and higher levels of education qualifications. It is also stipulated that the minimum wage is determined by the Government on the proposal of the Social Council, based on the general wage level in the country, living costs and their changes, and economic factors, including the requirements of economic development, productivity levels, and the need to achieve and maintain a high level of employment.
